Terms & Conditions
I hereby apply to participate in the Fast Track Corporate Running Series (“the Event”). In consideration of my application for entry to the Event being accepted, I acknowledge and agree that:
1. Only these terms and conditions and terms which cannot be excluded by law bind Corporate Health Events Management Pty Ltd ABN 92 139 911 916 (“CHEM”). All other conditions, warranties and representations are excluded. These terms and conditions can only be varied by CHEM’s written agreement.
2. I will comply with these terms and conditions and any reasonable direction issued by CHEM or its representatives.
3. To the extent permitted by law (including but not limited to the Trade Practices Act 1975 (Cth)), all terms and conditions which are not expressly provided in these terms and conditions are excluded. To the extent permitted by law, the liability of CHEM will be limited (at its discretion):
(a) in the case of goods, to the replacement, repair or payment of the cost of replacing the goods; and
(b) in the case of services, to the resupply of the services or payment of the cost of having the services supplied again.
4. I agree to:
(a) release CHEM from all claims, loss, damage or cost that I may have or incur, or may have had or incurred but for this release arising from or in connection with my participation in the Event; and
(b) indemnify and will keep indemnified CHEM in respect of any claims, loss, damage or cost by any person including another participant in the Event arising as a result of or in connection with my participation in the Event.
5. I am aware of the inherent risks involved in participating in the Event and accept them as my own.
6. I am and will continue to be medically and physically fit and able to participate in the Event. I am not and will not be a danger to myself or to the health and safety of others. I will immediately notify CHEM in writing of any change to my fitness and ability to participate. I understand and accept that CHEM will continue to rely upon this declaration as evidence of my fitness and ability to participate in the Event.
7. I accept that CHEM is not liable for any personal injuries (including illness and death) or property damage or economic loss suffered by me which may arise during, or out of, the Event.
8. I consent to CHEM using my name, image, likeness and my performance in the Event to promote the Event or any future similar events in any form of media without payment to or permission by me.
9. I acknowledge and agree that personal information about me will be used by CHEM to facilitate the conduct of the Event and other events conducted by CHEM. I consent to my name and details being entered onto a database held by CHEM relating to its business and agree that I may receive marketing material from CHEM from time to time.
10. I consent to receiving any medical treatment that CHEM considers necessary or desirable during or after the Event. I also agree to reimburse CHEM for any costs or expenses incurred in providing me with medical treatment.
11. The race organiser has consent to contact the participant or any of their listed contacts as they consider necessary or desirable during or after the Event.
12. Due to the pre-ordering of certain race items, no cancellations will be accepted after 5pm, 22 June 2011. For all cancellations prior to this date, we will provide a 50% refund upon request in writing to info@chem.net.au. If you are unable to attend and notify us after this date, we will only accept a transfer to another workmate.
13. Each entrant acknowledges that their entry fee is not refundable should they not participate.
14. Event organisers may change the Event format, course or other race conditions at their discretion. If that occurs, this agreement applies to the changed conditions.
15. I agree that if the Event is cancelled due to storm, rain, inclement weather, winds or other ‘Act of God’ conditions or safety concerns, or if I do not participate in the event for any other reason, my entry fee shall be non refundable.
16. I am 18 years of age or older
17. This release shall extend to and include all promoters, event sponsors, event marshals and their respective directors, partners, managers, officers, agents, contractors, employees and volunteers including event medical and paramedical personnel. This release and indemnity continues forever and binds my heirs, executors, personal representatives and assigns.
18. All Entrants must complete and submit an event entry and pay the applicable entry fee.
19. Each entrant acknowledges it is their responsibility to stay hydrated
20. Correct singlet sizes are only guaranteed for all entries received prior to 5pm, 22 June 2011. Entrants after this date may be given a singlet of another size than requested.
