chem :: corporate health events management

In consideration of Corporate Health Events Management Pty Ltd ABN 92 139 911 916 (“chem”) managing my entry into the event, I acknowledge and agree to the following terms and conditions:

Only these terms and conditions bind chem.  All other conditions, warranties and representations are excluded.  These terms and conditions can only be varied by chem’s written agreement.

1. I acknowledge and agree that this service is provided by chem as agent for my employer and is subject to any agreement between chem and my employer.
2. chem is not liable for any inaccuracy of any information given any brochures, proposals and presentations in relation to the event.
3. I will comply with these terms and conditions and any reasonable direction issued by chem or its representatives.
4. To the extent permitted by law (including but not limited to the Trade Practices Act 1975 (Cth)), all terms and conditions which are not expressly provided in these terms and conditions are excluded.  To the extent permitted by law, the liability of chem will be limited (at its discretion):

(a)        in the case of goods, to the replacement, repair or payment of the cost of replacing the goods; and

(b)        in the case of services, to the resupply of the services or payment of the cost of having the services supplied again.

1. I agree to:

(a)        release chem from all claims, loss, damage or cost that I may have or incur, or may have had or incurred but for this release arising from or in connection with my participation in the event; and

(b)        indemnify and will keep indemnified chem in respect of any claims, loss, damage or cost by any person including another participant in the event arising as a result of or in connection with my participation in the event.

1. I am aware of the inherent risks involved in participating in the event and accept them as my own.
2. I am and will continue to be medically and physically fit and able to participate in the event. I am not and will not be a danger to myself or to the health and safety of others. I will immediately notify chem in writing of any change to my fitness and ability to participate. I understand and accept that chem will continue to rely upon this declaration as evidence of my fitness and ability to participate in the event.
3. I accept that chem is not liable for any personal injuries (including illness and death) or property damage or economic loss suffered by me which may arise during, or out of, the event.
4. I consent to chem using my name, image, likeness and my performance in the event to promote the event or any future similar events in any form of media without payment to or permission by me. 
5. I acknowledge and agree that personal information about me will be used by chem to facilitate the conduct of the event and other events conducted by chem.  I consent to my name and details being entered onto a database held by chem relating to its business and agree that I may receive marketing material from chem from time to time.
6. I consent to receiving any medical treatment that chem or the event organiser consider necessary or desirable during or after the event.  I also agree to reimburse chem and the event organiser for any costs or expenses incurred in providing me with medical treatment.
7. These terms and conditions will bind my estate.
